Summer Is Not Over

1. Introduction

These are the terms and conditions (“TC”) which, apply to Summer’s not Over which we may run, whether on our website(s), social media platform(s) or otherwise (the “Promotion”).

In the TC, “we”, “us”, “our”, all mean Kiwi.com s.r.o., having its registered address at Lazaretní 925/9, Zábrdovice, 615 00 Brno, Czech Republic. 

2. Start and end date/time 

The Promotion will start on 22nd August 2022 and the closing date/time for a Promotion is on 18th September  2022 (the “Term”). All times will be based on CET time.

3. Entering a Promotion

The Promotion will be open to individuals aged 18 or over (at the time of entry) who:

  • are residents and are based in the United Kingdom, Germany or Spain (the “Territories”)  at the time of entering the Promotion
  • made at least one  booking via our mobile application and/or website www.kiwi.com (the “Booking”) as each Booking is considered as one entry to the Promotion
  • used a VISA card issued by a bank based in one of the Territories as payment instrument to pay for the respective Booking
  • agreed with these terms and conditions.

Our employees, freelancers, contractors (and those of any of our Promotion Partners, associated companies or prize providers) and their immediate family members or households (whether related or not), and anyone else professionally involved with the relevant Promotion, are excluded from entering any and all of our Promotions.

When entering a Promotion you must provide us with your real name which we will publish when announcing the winners of the Promotion. If you do not want your real name to be disclosed to the wider public, please let us know in advance. If you fail to provide us with your real name, you may be disqualified, at our discretion, and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.

4. Winners and Prizes

There will be one prize winner per each of the Territoiesy and per each calendar week of the Term as winner(s) will be selected at random by an automated process. 

The winners will be announced each week on Monday until 9:00 PM on Promotion’s website. We might also decide to share the winners via https://partners.kiwi.com/summer-is-not-over-yet/ and/our social media channels and/or via Kiwi.com Stories.

Each winner will receive a voucher/promo code (the “Voucher”) for the future purchase with us in values of EUR 3500 (as for Germany and Spain) and GBP 3000 for United Kingdom which will be sent to them in a reasonable timeline after the announcement.

The Voucher shall not be exchangeable for cash and shall be valid until 30th September 2023.

5. Final provisions

These TC are available in English, German and Spanish language. In case of any inconsistencies the English version shall prevail.

Information about processing of your personal data

Data Controller

Personal data of participants of the Promotion will be processed by Kiwi.com s.r.o., having its registered address at Lazaretní 925/9, Zábrdovice, 615 00 Brno, Czech Republic.

What, why and on what basis

We will use your personal data (namely identification information, contact information, payment information, information about your order) for the purpose of allowing you to participate in the Promotion, Promotion evaluation, to provide you with a prize and also for publication of winners on our websites and social media channels. This processing shall be done based on our legitimate interest to promote our services and products.

Where do we get your personal data

We collect the personal data which you submit to us through the Booking, or which you submit to us directly on the Promotion’s website.

Sharing your personal data

The personal data is processed and shared with third parties only to the extent, to which it is necessary, so we can choose and identify the winner, and make sure that the winner fulfilled all prerequisites to win. Therefore your personal data might be shared with Visa Inc. In limited circumstances and to the necessary extent, we might temporarily process your personal data internally within the Google Workspace apps operated by the company Google Ireland Limited. In order to publish winners on our social networks, we might share personal data with their providers, namely company Meta Platforms Ireland Limited which operates Facebook and Instagram.

Duration for which your personal data will be stored

We will process your personal data for the whole promotion term and then for the duration of statutory limitation period, which is generally 3 years, plus an additional 1 year because of the time reserve necessary for delayed deliveries of notices and our additional actions.

Your rights

We want you to always be in control of your personal data. To this end, you have certain rights that allow for it. Under certain conditions, you may: 

a) Gain access to all your data that we use or are processing, and even get a copy of all of it

b) Ask us to delete your data

c) Correct the data that we are processing if you think that there are mistakes

d) Restrict the processing of your data

e) Receive your Personal Data in a commonly used and machine-readable format or to have this data transmitted to a different provider,

f) Submit an objection against the processing of your personal data.

Complaints

Data protection is a serious matter and the rules are quite difficult to implement correctly. No one is perfect, and it may happen that we make a mistake. If you feel that we mishandled your Personal Data, please turn to us first. We promise that we will try our best to resolve the situation. You can always approach us with any privacy or data protection related issue at [email protected].

Nevertheless, at any time, you have the right to lodge a complaint with a supervisory authority. If you are from the EU, you can lodge a complaint at the authority in the member state of your residence, in the member state where you work or in the member state of the alleged infringement.
